The first point to covered will be the funding of your personal injury case. The basic principle is that the losing party pays the winning party’s legal fees. If your case is lost, you may be ordered to pay your opponent’s legal costs. Do not worry about this, since you can take out insurance to protect you against having to meet these fees. No interest is charged on any insurance and no loans are taken out.
Legal Expenses Insurance
We will always ask you whether you have some form of insurance cover which is already available to you and is therefore free of charge. This is called legal expenses insurance cover and might form part of your motor insurance, household insurance policy, credit cards or trade union cover. It forms an added benefit to the main policy that you have taken out. Using this insurance does not mean that you lose any no claims discount as you are not making any claim on the main policy.
A legal expenses insurance policy will usually provide full protection for your own solicitors and your opponent’s legal fees. It will also cover the full costs of disbursements which are things such as medical report fees and court fees.
No Win No Fee (Conditional Fee Agreement)
If you do not have a legal expenses insurance policy (As above), your solicitor may be able to take your case on a No Win No Fee arrangement. This means that if your case is unsuccessful, your legal costs do not have to be paid by you. In the event of you being successful, the legal costs are then recovered from your opponent so that you retain 100% of your compensation.
It is usually also appropriate to take our insurance to cover your opponent’s legal costs (which you might be ordered to pay if the case is unsuccessful). If your case was unsuccessful, the insurance policy would pay your opponent’s costs. The policy premium is usually deferred until the end of the case and is then submitted to the responsible party for payment along with your own solicitor’s costs. There is no interest to pay and no loans are taken out.
