Simon - Brain Injury following Motorbike Accident

Specialist Head Injury UK Solicitor, Andy Shaw, comments on some of the challenges presented in a recent brain injury case for Simon.

 

In June 2015, Simon sustained a severe brain injury when he was knocked off a motorbike. Initially, Simon felt very overwhelmed with the legal process and the amount of lawyers who contacted him. He did not know where to start and was struggling to come to terms with his significant injuries and worries about not being able to work. Unfortunately, Simon entered into an agreement with a lawyer who was not a specialist in brain injury cases and quickly realised that he had not made the right decision and needed specialist help. Simon consulted brain injury charity, Headway, and was referred to their brain injury solicitors guide, of which Head Injury UK is a member.

Specialist Brain Injury Solicitor, Andy Shaw, met with Simon who advised him of his options and supported him until he was comfortable to make a decision. Simon say says;

“When I made the decision to transfer my case to Andy he took complete control which was a huge weight off my mind. Just to have someone there at any time of the day was a huge benefit. Andy arranged an immediate needs assessment for me from an experienced brain injury case manager which was funded by the third party insurers. This case manager, together with Andy, supported me from start to finish. Property was an immediate  issue as I was living in a terrace property which was not conducive to my rehabilitation.  The environment was stressful and dangerous as I had to access the electricity metre which was in a cellar. Andy sought, and secured, an early interim payment which eased my financial worries considerably and allowed me to move into a new apartment.

Andy comments; “Simon’s symptoms were varied and included cognitive impairment, difficulties regulating his behaviour, impulsivity, balance, hearing impairment and a facial deformity following craniectomy. After meeting with Simon, I immediately identified that we needed to secure a substantial interim payments to assist in a property move allowing him to move into a new modern apartment which was an immediate improvement. This payment also helped with his loss of earnings. It was clear that Simon would never get back on a motorcycle, which had been his primary method of  transport and so we sought interim payments to assist him in learning to drive. This gave him his independence and confidence back. I engaged a raft of specialists to assist in Simon’s rehabilitation and in helping diagnosis some of the problems he was experiencing.  This included an occupational therapist, neurocognitive rehabilitation, support worker, neuropsychiatrist,  physiotherapist and ENT consultant.”

Only two years after the accident,  Andy secured a  settlement of £1,150,000 plus rehabilitation fees of £150,000 for Simon. Simon concludes;

I have come a long way since I have received the treatment that Andy put in place for me. I still suffer from tiredness and being generally “slow” but I now have the financial freedom and security to move forward. Andy was available and responsive outside of core business hours and had a down to earth inclusive approach. The legal advice was realistic, pragmatic and reassuring and I felt he always had my best interests at heart.”

Andy advises; “Choosing the right lawyer can be one of the most important decision you can make.   Even though you may have appointed a lawyer it does not mean that you cannot transfer your case to one who is a specialist.  There  is a huge difference between a personal injury lawyer and someone who specialises in serious injuries and in particular head injury.  Solicitors specialising in serious injuries will ultimately strive to put in place an effective rehabilitation package whilst at the same time focusing on building the compensation claim.  Trying to help the person to achieve their maximum recovery has to be the main priority and I was pleased to help Simon rebuild his life and secure his financial future albeit in such tragic circumstances. “
