Criminal Injury Compensation Authority: Head Injury

CICA Reforms

In future any victim of criminal violence who suffers minor injury will be unable to claim any CICA compensation.  Government proposals that someone who currently receives an award of up to £2,000 would get nothing.  Other awards would also be reduced, for example, £2,500 becoming £1,000 and £5,500 reducing to £3,500.

Focus on Serious Injury

The stated aim of the reform is to target resources on the most seriously injured victims of crime, so an award of £11,000 and above will not be cut.  In addition, overseas terrorist attack victims would, for the first time, get compensation through a special scheme and to help fund the new service the government will raise £50m from criminals by increasing the victim surcharge and drivers’ fines.

Whilst there is concern about how the changes will impact some innocent victims, the reforms importantly protect the entitlement of the most seriously injured, including victims with serious head or brain injury.
