Falling Roofer with Severe Brain Injury

Mark Lambton was left severely brain damaged in a fall from a house roof in July 2011.  J Wilson Home Improvements had hired him to replace and point tiles and fit a dry verge system.  Mark was clearing concrete debris off the roof however, when moving onto a set of ladders, he fell around 6 or 7 metres onto a path.

Permanent Traumatic Brain Injury, despite Treatment

The 50 year old was rushed to hospital where he was placed into a drug-induced coma for more than two months.  Unfortunately he remains severely brain damaged, in a vegetative state and with no likelihood of improving.

No safety measures: “Totally Unacceptable”

A Health and Safety Executive (HSE) investigation found that there were no precautions to prevent workers from falling from the roof and the contractor has recently been fined for breaching the relevant regulation.  The HSE Inspector said,

"The dangers of death and serious injury associated with falls from height during roof work are well known, and allowing such work to be carried out without any safety measures is totally unacceptable.  This incident could have been easily avoided if appropriate edge protection and safe access had been put in place to prevent falls."

What our clients say

We know that we have been extremely fortunate to have had such a consummate PI lawyer in Andy acting on our behalf but we have also been blessed by having had his support, trust, friendship and loyalty throughout. We cannot ever thank him enough.

The compensation Nicola has received has helped her move from a tiny council flat into a massive bungalow which has been specifically adapted. It has enabled her to have a better life.

If it was not for the help of my solicitor I don't know where I would have been today. He provided a great deal of emotional support and secured compensation at various stages from the insurance company to fund my treatment and allow me to live. He was there from start to finish.

Higgs & Sons acted for us for 5 years until our daughters claim for personal injuries was finally settled. Ian remains a trustee of our daughters trust fund and we now look upon him as a friend.
