Flagpole causes toddler's head injury

A council fined earlier this month, ignored warnings from its own staff about a rotting flagpole, which then collapsed and fractured a two-year-old girl’s skull.

‘It is pure luck that this young child wasn’t killed.’

The toddler had been playing in a park with her mother when the 5.5m wooden flagpole fell without warning.  She suffered a head injury and fractured foot.  Hospitalised for a week, she is reported to need ongoing health monitoring for years to come.

‘Warnings were either not heard or not heeded’

The Health and Safety Executive (HSE) successfully prosecuted the council, which was fined £12,000 for not preventing the accident.  Apparently, over nearly 18 months before the accident council staff on at least 3 occasions had alerted that the pole was decaying and needed attention.  Still nothing was done.

The HSE Inspector said, ‘This was an 18-foot, heavy wooden flagpole that toppled without warning in a public garden. It is pure luck that this young child wasn’t killed. It was an incident that was easily preventable … but it seems the warnings were either not heard or not heeded.’  At Head Injury UK we work with many clients whose head injury or brain injury unfortunately was easily avoidable.  To see how we can help you or a loved one, just contact Andy Shaw.

What our clients say

We know that we have been extremely fortunate to have had such a consummate PI lawyer in Andy acting on our behalf but we have also been blessed by having had his support, trust, friendship and loyalty throughout. We cannot ever thank him enough.

The compensation Nicola has received has helped her move from a tiny council flat into a massive bungalow which has been specifically adapted. It has enabled her to have a better life.

If it was not for the help of my solicitor I don't know where I would have been today. He provided a great deal of emotional support and secured compensation at various stages from the insurance company to fund my treatment and allow me to live. He was there from start to finish.

Higgs & Sons acted for us for 5 years until our daughters claim for personal injuries was finally settled. Ian remains a trustee of our daughters trust fund and we now look upon him as a friend.
