Legal Aid : The Price of Justice?

The government’s wide-ranging austerity plan to save money wherever possible includes our civil justice system, but is this at the cost of access to justice and a fair society?

Clinical Negligence

Removing Legal Aid from clinical negligence claims is part of the cost-cutting plans and legislation is currently in its final stages. Whilst there is opposition from those genuinely concerned for our justice system, the public do not widely appreciate the proposed changes.

Legal Aid was removed from personal injury claims over 10 years ago when the government also introduced the current no win no fee system, the idea being that clients no longer eligible for Legal Aid could still access justice with its no win no fee system.  Now though in addition to the current Legal Aid reduction, the government is also altering the no win no fee system, but this time in a way that is likely to reduce access to justice further still.

Head Injury UK; Helping Brain Injured Babies

The Government has conceded keeping Legal Aid for new-born babies left with severe brain injury as a result of clinical negligence.  At Head Injury UK we are especially pleased with this news, as we act for a number of clients who suffered brain injury at birth, such as cerebral palsy.  We know how difficult and costly they are to prove, and are pleased for the sake of the injured children that their Legal Aid at least is kept.  If you want to discuss how we can help you with such a birth injury claim, please contact Clare Langford.

What our clients say

We know that we have been extremely fortunate to have had such a consummate PI lawyer in Andy acting on our behalf but we have also been blessed by having had his support, trust, friendship and loyalty throughout. We cannot ever thank him enough.

The compensation Nicola has received has helped her move from a tiny council flat into a massive bungalow which has been specifically adapted. It has enabled her to have a better life.

If it was not for the help of my solicitor I don't know where I would have been today. He provided a great deal of emotional support and secured compensation at various stages from the insurance company to fund my treatment and allow me to live. He was there from start to finish.

Higgs & Sons acted for us for 5 years until our daughters claim for personal injuries was finally settled. Ian remains a trustee of our daughters trust fund and we now look upon him as a friend.
