NHS claim by girl left disabled by hospital

A girl left with brain damage by Newcastle’s Royal Victoria Infirmary 9 years ago has now, at the age of 12, won Court approval for the NHS to pay 80% of her claim.

NHS Claim Denied

As is common, the NHS denied liability for the girl’s brain injuries suffered whilst being treated for leukaemia.  To start with the NHS said she was likely to have suffered brain damage anyway, so she had to take them to Court before they finally accepted blame. 

NHS Claim Admitted

Now, the NHS admits that doctors did not properly review an x-ray, so missing a chance to treat her after she developed a life-threatening infection.  As a result, she deteriorated and suffered a heart attack whilst being prepared for surgery. 

Substantial Compensation to be decided

Left with physical and mental disabilities from her brain injury, the amount of substantial compensation the girl will receive for her NHS claim is still to be agreed with the NHS.  Possibly the amount will have to be decided at a later Court trial if it cannot be agreed.
