What is the Court of Protection?  Who are Deputies?

If a client lacks mental capacity following their injury, we use our experience to guide them and their family through the Court of Protection process.  We also have a solicitor who is experienced as acting as their Deputy, if appropriate, and you can read more about these matters here.

What are Personal Injury Trusts?

However, even if a client has capacity they may still well benefit from putting their damages into trust for a number of reasons.  For example,

• Funds held in trust are disregarded when assessing eligibility for some means tested state benefits and services.  So a client protects their benefits in the future.  Means tested benefits include income support, income related employment and support allowance, income based job seekers allowance, housing benefit and council tax benefit. 
• A trust also protects entitlement to local authority funding for the costs of living in a residential care home and possibly care provided in a person's own home.
• A personal injury trust also protects the very young, old, disabled or otherwise vulnerable people.  As trustees must authorise all transactions this protects against inappropriate use of funds.  It also ensures that funds are managed appropriately and protects the client's long term interests.
