A £10.8m birth injury settlement, believed to be one of the largest in a medical negligence claim, will pay for lifetime care for 11-year-old Milly Evans, who has cerebral palsy, cannot speak and is dependent on others.
Birth Injury Negligence
The NHS agreed to pay compensation after the hospital failed to monitor Milly’s mother adequately during labour, which led to Milly suffering catastrophic injuries when she was born. The High Court settlement includes a lump sum of £5.9m and periodic payments throughout her life of up to £204,000 a year. Milly's barrister, told the court it was a tragic case and "yet another incident of an avoidable accident at birth which caused devastating injuries".
Cerebral Palsy Injury
Milly who uses wheelchair is also unable to speak. Her intellect though is fairly well intact and she communicates through sophisticated eye-gaze equipment. The family will use the compensation to move into an adapted home with hoists and a hydrotherapy pool. It will also pay for past and future full-time care for Milly, as well as treatment, education, special equipment, transport and loss of future earnings. Though, the barrister added, "The money will never make up for the mistake that condemned Milly to a lifetime of dependency on others."
