The National Audit Office has found that 20% of all money spent on NHS maternity care pays for litigation cover. The actual cost was £482m in 2012-13.
Although birth injury claims made up 12% of all claims, they accounted for a third of all clinical negligence payments made by the NHS Litigation Authority. The average cost per case is so high because the compensation for badly injured infants has to cover the cost of their care for the rest of their lives.
This comes at a time when NHS figures show that there still are not enough midwives in our hospitals over half of obstetric units aren’t meeting consultant staffing levels as recommended by the Royal College of Obstetricians and Gynaecologists. The lack of resources on maternity wards is a likely reason for the continuing rise in birth injury claims.
