Sam Boreham was travelling with his twin brother Ben to a football match in Manchester, when involved in a serious crash on the M1 motorway. It left him with permanent brain damage and disability. The road accident occurred in 1998 when Sam and Ben were aged only 8 years old.
The insurers for the driver who admitted fault have recently agreed at the High Court to pay a lump sum and periodical payments to Sam, likely to total over £2.5m compensation.
Sam is now 21 years old. It was not possible to reach an earlier settlement due to the need for Sam to reach adulthood to identify the full extent of his disabilities, which is not unusual in cases involving seriously brain injured children.
This case however was most unusual because Sam’s uninjured twin brother was used as an accurate benchmark when working out the effect of Sam’s brain injury. With Ben it was possible to calculate the extent of Sam’s brain damage and so the right compensation.
